General

BackgroundA. This is an agreement for a Cabin Rental at Trailhead Cabins and Camping, according to the terms set out below.
B. Trailhead Cabins and Camping, the Renter and the Premises are as set out in Schedule 1 of this Agreement.
C. Collectively, Trailhead Cabins and Camping and Renter will be referred to as ‘The Parties’. IN CONSIDERATION OF Trailhead Cabins and Camping letting and the Renter renting the Premises, both parties agree to keep, perform and fulfil the following promises, conditions and agreements:
Rental AmountThe Total Rental Amount for the period, in US Dollars, is set out in Schedule 1.
The Nightly Rental Amount is also set out, in US Dollars, in Schedule 1.
EssentialsTrailhead Cabins and Camping will provide the items listed as Essentials in Schedule 1 to the Renter upon arrival.
Use of PropertyRenters expressly acknowledge and agree that this Agreement is for transient occupancy of the Property at 20266 UU Avenue, Steamboat Rock, IA, and that Renters do not intend to make the property a residence or household.
PossessionsValuable items left behind by Renter will be held for the Renter and every reasonable effort will be made to contact the Renter for return. If items are not claimed for longer than 6 months they shall become the property of Trailhead Cabins and Camping. Trailhead Cabins and Camping shall not be held liable for condition of said items.

NoticesNotices are to be provided, in writing, to the address for each of the Parties set out in Schedule 1.
Notices may be delivered by email or through the United States Postal Service.
House RulesThe Renters undertake to comply with the House Rules notified to them by Trailhead Cabins and Camping and agree that such House Rules shall be incorporated into this Agreement.
Governing LawThis Agreement is governed by the laws of the State in which the Premises stand (State of Iowa). In the event of uncertainty over where the Premises stand, Trailhead Cabins and Camping shall nominate the state of Jurisdiction and Governing Law.
NO Open Flames or Candles
Children under 14 must be supervised.
MAIN HOUSE AND SHOP ARE OFF LIMITS!!!
SWIM AT YOUR OWN RISK
Water shoes are highly recommended.
NO THROWING MUD or ROCKS
NO DIGGING IN THE POND.

NO GLASS CONTAINERS
DOOR CODE WILL BE SENT TO PRIMARY RENTER.
Thermostat remotes are hanging on the wall.
All kitchen appliances are stored under the kitchen sink.
Extra toilet paper is under bathroom sink.
Check out is at 11:00 AM
Put used towels in bathroom.
Leave beds unmade.
WASH ALL DISHES AND PUT AWAY
Turn thermostat back to where you found it.
Put all remotes back to where you found them
Close and lock all windows
Turn off all lights
Close the door, but DO NOT LOCK THE DOOR

Site capacity

The maximum number of guests allowed in the renting party is specified in Schedule 1.
The renting party must not exceed the maximum number of guests specified in Schedule 1.
No extra overnight guests are allowed; additional fees apply for violations.

Fees & deposits

Renters must pay all required fees, taxes, and deposits as specified in Schedule 1 by check-in time.

Cancellation policy

Violating terms can result in immediate termination of the rental agreement; renters must vacate the premises upon termination.

Safety & rules

Renters must keep the premises clean and will be charged for damages or excessive cleaning, including a $500 fee for smoking or vaping.
Renters must dispose of waste as instructed by Trailhead Cabins and Camping according to House Rules.
Renters must respect others and maintain a quiet environment; disturbances can lead to eviction.
Smoking inside the property is prohibited according to House Rules.
Only legally owned firearms are permitted on the premises.
Fireworks and hazardous materials are prohibited on the property.
Renters must promptly report any fire alarm issues to Trailhead Cabins and Camping.
Swimming is at your own risk; the property is not liable for accidents or injuries.
There is no lifeguard on duty at the swimming area.
Unplug the pond fountain before entering the water.
Children under 14 must be supervised by an adult at all times.
Please pick up trash and do not litter.
Swimming in the pond is not allowed during thunderstorms.

Pets

No pets or animals are allowed on the premises.
Pets are not allowed on the premises.
We do have 2 dogs. DO NOT Engage with them unless the host has granted permission.

Noise

The Renters undertake to abide by any period of Quiet Time notified to them by Trailhead Cabins and Camping.
For the purposes of Clause 17 of this Agreement, Trailhead Cabins and Camping will be taken to have notified the Renters of Quiet Time if such notification is included in the House Rules.

Guests

Trailhead Cabins and Camping’s Liability (including Jarret and Kim Wininger)The Renters and Renters' Guests shall hereby indemnify and hold harmless the Trailhead Cabins and Camping/Jarret and Kim Wininger against any and all claims of personal injury or property damage or loss arising from use of the premises or pond regardless of the nature of the accident, injury or loss. Renters expressly recognize that any insurance for property damage or loss which Trailhead Cabins and Camping or Jarret and Kim Wininger may maintain on the property does not cover the personal property of Renters, and that Renters should purchase their own insurance for Renters and Guests if such coverage is desired.
Be considerate and respectful of other pond guests.
Every guest should be aware of and help to enforce these rules to help ensure that the pond area is enjoyable and safe for all guests. Please understand the pond is man made with and held with a CLAY LINER. If the liner is punctured this could effect all guest enjoying the pond. Rules are strictly enforced. Management has THE FINAL AUTHORITY IN ALL MATTERS REGARDING SWIMMING AT THE POND. OTHER ACTIONS NOT MENTIONED IN THESE RULES MAY BE DEEMED UNSAFE BY THE Management. Management has THE AUTHORITY TO EJECT SWIMMERS FOR THE DAY, WEEKEND OR SEASON based on their sole discretion.

Deposit

Rental DepositAmount is fully refundable up until 30 days prior to the Check In Date and Time. After this date, Trailhead Cabins and Camping shall have the right to retain the Rental Payment at Trailhead Cabins and Camping's discretion.
Attorney’s FeesRenters agree to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Trailhead Cabins and Camping enforcing this agreement.
Shortened Stays and ConditionsThere shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions.
Illegal UseRenter shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc. shall cause termination of this agreement with no refund of rents or deposits.
WIFI TVWIFI TV is provided at the discretion of Trailhead Cabins and Camping. The level of service is chosen by Trailhead Cabins and Camping. No refund of rents shall be given for outages, content, lack of content, or personal preferences with regard to streaming TV service.
WIFIWIFI is provided at the discretion of Trailhead Cabins and Camping as a convenience only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to WIFI.
